Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Individual Entrepreneur Shota Topchishvili (“we”, “us”, or “our”) and govern your use of the Carnix application and related services (the “App”). They also serve as the End User License Agreement (“EULA”) for the App. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial diagnostic use, subject to these Terms and the store rules of Apple or Google. Certain premium features are licensed on a per-vehicle (per-VIN) basis, meaning an entitlement is tied to the vehicle it was activated for.

2. Subscriptions, billing & renewals

Carnix offers a free tier and an optional paid “Pro” subscription available monthly or yearly.
Subscriptions are auto-renewing. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
Your subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
Where a free trial is offered, any unused portion is forfeited when you purchase a subscription. Except where required by law, payments are non-refundable; refund requests are handled by Apple or Google under their policies.

3. Acceptable use

You agree not to:

Reverse engineer, decompile, or modify the App except as permitted by law;
Resell, sublicense, or commercially exploit the App without our consent;
Use the App to violate any law or third party’s rights;
Interfere with, disrupt, or attempt to gain unauthorized access to our systems.

4. Safety notice & intended use

Carnix is an informational tool. It is not a substitute for inspection or repair by a qualified professional mechanic. You are responsible for the safe operation of your vehicle at all times.

Do not operate the App while driving. Do not let it distract you. Any performance-measurement features must only be used lawfully on a closed course or private track, never on public roads.
Clearing a diagnostic trouble code does not repair the underlying problem. Do not rely on the App to determine that a vehicle is safe to drive.
Always follow your vehicle manufacturer’s guidance and applicable traffic and safety laws.

5. Hardware compatibility

Carnix works with standard ELM327-based OBD-II adapters. We do not manufacture or sell adapters and are not responsible for third-party hardware. Data accuracy depends on your vehicle, its ECU, and the adapter you use; some vehicles or codes may not be fully supported.

6. Intellectual property

The App, including its software, design, text, and branding, is owned by Individual Entrepreneur Shota Topchishvili and protected by intellectual-property laws. These Terms grant you a license only; they do not transfer any ownership to you. Your diagnostic data remains yours.

7. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that diagnostic results, explanations, or repair suggestions are complete, accurate, or error-free.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDIVIDUAL ENTREPRENEUR SHOTA TOPCHISHVILI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, VEHICLE DAMAGE, OR REPAIR COSTS ARISING FROM YOUR USE OF OR RELIANCE ON THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including Sections 6–8, 10, and 11) will survive.

10. Governing law

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws rules. The courts located in Tbilisi, Georgia will have jurisdiction over any dispute, except where mandatory local consumer law provides otherwise.

11. Apple App Store — additional terms

The following applies when you obtain the App from the Apple App Store:

These Terms are between you and Individual Entrepreneur Shota Topchishvili only, not with Apple. Apple is not responsible for the App or its content.
Your license to use the App is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
Apple has no obligation to provide maintenance or support for the App. Any support requests should be directed to us at support@carnixapp.com.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is not responsible for addressing any claims relating to the App, including product-liability, legal-compliance, or intellectual-property claims.
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by an in-app notice. Continued use of the App after changes take effect constitutes acceptance.
