Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Estate Group LLC (“we”, “us”, or “our”) and govern your use of the Carnix application and related services (the “App”), and any purchase you make from us, in the App or on this website. They also serve as the End User License Agreement (“EULA”) for the App. By downloading or using the App, or placing an order, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial diagnostic use, subject to these Terms and, where you obtained the App from the Apple App Store, Apple’s store rules (see Section 12). Certain premium features are licensed on a per-vehicle (per-VIN) basis, meaning an entitlement is tied to the vehicle it was activated for.

2. Subscriptions, billing & renewals

• Carnix offers a free tier and an optional paid Premium subscription, available monthly, every three months, or yearly. A Premium subscription is licensed to one vehicle, identified by its VIN, and can be extended to cover additional vehicles or moved to a different one from within the App. The current price and billing period are shown in the App before you purchase.
• Subscriptions are auto-renewing. On iOS, payment is charged to your Apple ID at confirmation of purchase. On Android, the App is not distributed through Google Play: payment is charged in Georgian lari to the card you enter, processed by our payment provider Flitt, and by purchasing you authorise us to charge that card again at each renewal and for any upgrade you choose.
• Your subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• On Android, adding a vehicle takes effect immediately and is charged the prorated difference for the rest of the current period; removing a vehicle or changing the billing period takes effect at the next renewal. If a renewal charge fails we retry it, and if it has still not succeeded three days after the period ends, the subscription ends.
• On iOS, manage or cancel your subscription in your App Store account settings. On Android, manage or cancel it in the App under Settings → Manage subscription. Either way, Premium continues until the end of the period you paid for. Deleting the App does not cancel a subscription.
• Where a free trial is offered, any unused portion is forfeited when you purchase a subscription. Except where required by law, payments are non-refundable. On iOS, refund requests are handled by Apple under its policies; on Android, contact support@carnixapp.com. A payment that is refunded, reversed, or charged back ends the subscription it paid for.

3. Acceptable use

You agree not to:

• Reverse engineer, decompile, or modify the App except as permitted by law;
• Resell, sublicense, or commercially exploit the App without our consent;
• Use the App to violate any law or third party’s rights;
• Interfere with, disrupt, or attempt to gain unauthorized access to our systems.

4. Safety notice & intended use

Carnix is an informational tool. It is not a substitute for inspection or repair by a qualified professional mechanic. You are responsible for the safe operation of your vehicle at all times.

• Do not operate the App while driving. Do not let it distract you. Any performance-measurement features must only be used lawfully on a closed course or private track, never on public roads.
• Clearing a diagnostic trouble code does not repair the underlying problem. Do not rely on the App to determine that a vehicle is safe to drive.
• Always follow your vehicle manufacturer’s guidance and applicable traffic and safety laws.

5. Hardware compatibility

Carnix works with standard ELM327-based OBD-II adapters: the Carnix adapter we sell (Section 6) and third-party adapters alike. We are not responsible for third-party hardware. Data accuracy depends on your vehicle, its ECU, and the adapter you use; some vehicles or codes may not be fully supported.

6. Adapter orders: price, payment, delivery & returns

• What you buy. The Carnix Bluetooth OBD-II adapter, sold by Estate Group LLC on this website and in the App. The price is shown in Georgian lari before you pay, currently 19.99 ₾ including all applicable taxes, with free delivery. We charge only the amount shown at checkout. An adapter included free with a 3-month or yearly Premium plan is part of that plan and is not sold or refunded separately.
• Payment. You pay on the secure page of our payment provider, Flitt, by Visa or Mastercard card, Apple Pay or Google Pay. Card details never reach us. Your order is confirmed when Flitt confirms the payment; until then nothing is charged and nothing ships. You confirm a Georgian mobile number by SMS when ordering: it is the number the courier calls.
• Delivery. We deliver in Georgia only, by courier, normally within 1–5 business days of payment. The courier calls the confirmed number to agree a time. If an order cannot be delivered because we cannot reach you, we will contact you by phone or email; if it still cannot be delivered, we cancel it and refund it in full.
• Right of withdrawal. Under the Law of Georgia on the Protection of Consumer Rights you may cancel an adapter order within 14 calendar days of receiving it, without giving a reason, provided the adapter is unused, undamaged and in its original packaging. Email support@carnixapp.com with your order number and we will tell you how to return it; return shipping is at your cost unless the adapter is faulty. We refund the full price to the card you paid with within 14 days of receiving the adapter back.
• Faulty adapters. If the adapter is faulty or does not match its description, you are entitled to a replacement or a full refund, as Georgian consumer law provides. Email us and we will arrange it at no cost to you.

7. Intellectual property

The App, including its software, design, text, and branding, is owned by Estate Group LLC and protected by intellectual-property laws. These Terms grant you a license only; they do not transfer any ownership to you. Your diagnostic data remains yours.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that diagnostic results, explanations, or repair suggestions are complete, accurate, or error-free.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTATE GROUP LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, VEHICLE DAMAGE, OR REPAIR COSTS ARISING FROM YOUR USE OF OR RELIANCE ON THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including Sections 7–9, 11, and 12) will survive.

11. Governing law

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws rules. The courts located in Tbilisi, Georgia will have jurisdiction over any dispute, except where mandatory local consumer law provides otherwise.

12. Apple App Store — additional terms

The following applies when you obtain the App from the Apple App Store:

• These Terms are between you and Estate Group LLC only, not with Apple. Apple is not responsible for the App or its content.
• Your license to use the App is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the App. Any support requests should be directed to us at support@carnixapp.com.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product-liability, legal-compliance, or intellectual-property claims.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by an in-app notice. Continued use of the App after changes take effect constitutes acceptance.
